While more than 3 million California citizens are awaiting state unemployment benefits because of Governor Gavin Newsom’s order for statewide lockdown, the governor announced last week he was extending $75 million to undocumented immigrants to be passed-through unnamed regional non-profit associations.
However, the Center for American Liberty’s lawsuit, in coordination with The Dhillon Law Group, filed an emergency petition with the California Supreme Court Wednesday asking the Court to immediately halt Governor Newsom’s appropriation of $75 million for the undocumented immigrants.
As attorney Mark Meuser with the Center for American Liberty and the Dhillon Law Group explained, the federal government and California both have statutes that prohibit providing unemployment benefits to undocumented immigrants, and violates the state’s Constitution.
“We are asking the court on an emergency basis to rule that Gavin Newsom not be allowed to expend these funds,” Meuser said.
Thursday, the California Supreme Court challenged Gov. Newsom’s overreach and ordered the governor and California Attorney General Xavier Becerra to respond to the Center for American Liberty’s emergency Writ.
Attorney Harmeet Dhillon celebrated this decision with a Tweet:

“The Governor made clear in his comments that he is giving $75 million in lieu of unemployment benefits that state and federal law bar to aliens working here illegally,” said attorney Harmeet Dhillon, Chief Executive Officer of the Center for American Liberty. “It is also concerning that unnamed nonprofits, who have no accountability to the taxpayer, are going to receive and distribute taxpayer dollars.”
“This is taxpayer money that may only be appropriated by the legislative branch. This is not a slush fund for the Governor to spend as he sees fit,” Dhillon said. “Governor Newsom is ignoring the proper, and constitutional, channel to appropriate funds. At a time when law-abiding Californians are crushed by unemployment, housing issues, business closures, and massive limitations on our normal lives, Governor Newsom is doing an end-run around the legal guardrails in place. There is no accountability over the distribution of these funds to individuals legally not entitled to cash benefits. The laws apply to everyone, even the Governor, and we hope the California Supreme Court will agree.”

There is a legal process. Documented workers are more than welcome to come work here. I would approve of signing up workers on their side of the border and arranging transportation to bus workers in to work during the week and bussing them back for the weekends. Of course this would only be practical in the southern states.

The program exists, we have been getting our work force for the tomato harvest for 3 seasons and now getting ready for our 4th season with H-2A workers, the workers are provided with a work Visa on a temporary or seasonal basis which provides a guaranteed labor force for employers to get the job done. Undocumented immigrant workers in California ALONE paid $2.5 Billion dollars in taxes with an ITIN (individual tax ID number) in 2019. These are NOT YOUR TAXES. It’s their money that they paid because they have to just like everyone else does. Yet they can’t qualify for unemployment, receive any federal help, and will never be able to receive SSI or retire. The IRS allows them to pay taxes as they should like every other worker in the US.

Taxpayers pay the hospital bills for illegal births, food stamps, welfare, Section 8 (free housing), now we give them unemployment. It's time to stop punishing the "LEGAL citizens" in order to support the illegals. The results are catastrophic. Just look at how the Dems caused the homeless crisis in San Francîsco and Los Angelos. Democrat Rent Control Laws destroyed landlords. Landlords abandoned ship. Now the price of rent is sky-high. No, it does not help to punish law abiding citizens to reward people who have no regard for the law.
Very glad to know that Harmeet Dhillon is taking action to put a stop to this outrage by Gavin Newsom (and his mystery non-profit friends). Will be following this!

Can they sue due to the fact children are being abused, parents literally are missing their kids, and cant find their kids trapped in abusive homes right now... There is no legal recourse available to help women and children being abused. EDD denies people money for no reason and then gives the NO WAY to appeal.

While I live in the same state as you I feel a world away. You asked us to help you, we did. You asked us to close our business, we did. You asked us to stay home, we did. You asked us to continue to stay at home, we are. So here I am, at home, waiting. You told us don’t worry unemployment will come, it hasn’t. You told us don’t worry grants are coming, they haven’t. You told us don’t worry forgivable loans are coming, they haven’t. You told us don’t worry stimulus money is coming, it hasn’t. So here I am, at home waiting. I wait alongside most of my fellow small business owners, those self-employed and independent contractors. A massive number of California residents who are waiting for the Unemployment portal to open for us, waiting for loan approvals, waiting for stimulus checks. All of these programs, we are at the back of the line for. So here we wait. While bills come daily, savings continuously dwindling and still doing our part. It is time you do yours. It is an inconceivable expectation to close unessential business halting all income and expect us to survive. We need to pay our bills and put food on the table. Without immediate action, you are leaving us no options. How are we to survive? We deserve an answer. Coming soon is no longer acceptable!!!

Did you know that undocumented migrant workers and hotel workers etc. pay into docial security. even though undocumented but that they can not get govt. benefits?
There is such an easy cure for that: Come to the United States legally. The immigrants need to stop listening to the Dems who promise to "take care" of them. The Dems have created such rivalry and resentment towards the illegal immigrants. It's not fair that all this resentment and disgust is aimed at the illegals when it really should be directed at the Dems who have created this mess. You would not treat your step-child better than your own, nor would you treat your own better than you step-child. Treat them equally. Same laws, same rules, same benefits.
They get welfare, medical insurance, free school (breakfast and lunch in Ca) and college, what do you mean they (illegal immigrants) don’t get any government benefits?
It's the cost of doing business for an illegal alien, they don't like it? Then do it legally.
Social security does not fund unemployment benefits.
That is the price they pay entering illegally instead of following the rules like the millions who enter legally. Ask all the foreign engineers in the silicon valley.
Go back, file the required documents, pay the fees and wait to be processed for a green card to work legally.
Undocumented is the key word so with that said they do not deserve anything because they are in out country illegally !

I am against any of our public funds to be given to illegal immigrants.
