General Provisions of the Civil Discovery Act

Allows the parties by written stipulation to modify the procedures

Chapter 1 of Title 4 of Part 4 of the Code of Civil Procedure contains general provisions of the Civil Discovery Act. Section 2016.010 named the Act.

Section 2016.020 defines the following terms: “action,” “court,” “document,” “electronic,” “electronically stored information,” and “writing.”

Section 2016.030 allows the parties by written stipulation to modify the procedures provided by this title for any method of discovery permitted.

Section 2016.040 requires a meet and confer declaration in support of a motion to state facts showing a reasonable and good faith attempt at an informal resolution of each issue presented by the motion.

Section 2016.060 specifies that, when the last day to perform or complete any act provided for in this title falls on a Saturday, Sunday, or holiday, the time limit is extended until the next court day closer to the trial date.

Section 2016.070 provides that this title applies to discovery in aid of enforcement of a money judgment.

Section 2016/090 requires 12 items to apply in a civil action unless modified by stipulation by all parties to the action. However, this section does not apply five specified actions. This section applies between 2024 and 2027.
