Pacific Marine Fisheries Compact

Fish and Game Code deals with the Pacific Marine Fisheries Compact

Division 11 of the Fish and Game Code deals with the Pacific Marine Fisheries Compact. Chapter 1 provides general provisions.

Section 14000 authorizes the Governor to execute a compact on behalf of this state with any or all of the States of Alaska, Idaho, Oregon and Washington for the purpose of cooperating with those states in the formation of a Pacific States Marine Fisheries Commission.

Section 14001 provides that the form and contents of the Pacific Marine Fisheries Compact must be substantially as provided in this section and the effect of its provisions are to be interpreted and administered in conformity with the provisions of this division.

Chapter 2 provides for the Commission. Section 14100 specifies that there are three members of the Pacific States Marine Fisheries Commission from the State of California, appointed by the Governor by and with the advice and consent of the Senate. The requirements for each of the three commissioners is specified.

Section 14101 states that the term of each commissioner is four years. A commissioner holds office until his or her successor is appointed and qualified but the successor’s term expires four years from the legal date of expiration of the term of his or her predecessor. Any commissioner may be removed from office by the Governor upon charges and after a hearing.

Section 14102 provides that each commissioner who is not also a state officer receives $100 for each day performing official duties pursuant to the direction of the commission, and each commissioner receives actual and necessary travel expenses incurred in performing official duties on behalf of the commission.

Section 14103 specifies that all officers of the State are authorized and directed to do all things falling within their respective provinces and jurisdiction necessary or incidental to the carrying out of the compact in every particular. The policy of this State is to perform and carry out the compact and to accomplish the purposes.

Section 14104 requires the commission to keep accurate accounts of its activities and must report to the Governor and the Legislature on or before the thirty-first day of December in each year.

Section 14105 requires the Governor to attach his signature to the compact under a recital that the compact is executed pursuant to the provisions thereof, subject to the limitations and qualifications contained in the sections of this division in aid and furtherance of it.
