General Provisions and Definitions in the Harbors and Navigation Code

A project under the Public Contract Code, when performed by the state, is subject to the State Contract Act

Division 1, Chapter 1 provides general provisions and definitions for the Harbors and Navigation Code. Section 30 specifies that the general provisions and definitions in this chapter govern the construction of this division.

Section 30.5 provides that the term “Business, Transportation and Housing Agency” refers to the Transportation Agency.

Section 32 defines the terms “department” and “division.”

Section 33 defines the terms “director” and “deputy director.”

Section 34 defines the term “harbor.”

Section 35 defines the term “channel.”

Section 36 defines the term “navigable waters.”

Section 38 provides that the adoption, repeal, amendment, or modification of any rules or regulations must be done in accordance with the Administrative Procedure Act.

Section 39 specifies that any construction or development authorized by this division that also constitutes a project under the Public Contract Code, when performed by the state, is subject to the State Contract Act.

Section 40 states that facilities in harbors and connecting waterways established under the provisions of this division are open to all on equal and reasonable terms.
