Venue and Jurisdiction in Arbitration

Any petition made prior to the commencement of arbitration must be filed in a court having jurisdiction one of three specified counties

Code of Civil Procedure Part 3, Title 9, Chapter 5, Article 2 deals with venue, jurisdiction, and costs relating to judicial proceedings for arbitration.

Section 1292 provides that any petition made prior to the commencement of arbitration must be filed in a court having jurisdiction one of three specified counties.

Section 1292.2 specifies that any petition made after the commencement or completion of arbitration is to be filed in a court having jurisdiction in the county where the arbitration is being or has been held.

Section 1292.4 states that, if a controversy referable to arbitration under an alleged agreement is involved in an action or proceeding pending in a superior court, a petition for an order to arbitrate must be filed in such action or proceeding.

Section 1292.6 specifies that, after a petition has been filed under this title, the court in which the petition was filed retains jurisdiction to determine any subsequent petition involving the same agreement to arbitrate and the same controversy.

Section 1292.8 says that a motion for a stay of an action on the ground that an issue therein is subject to arbitration is to be made in the court where the action is pending.

Section 1293 explains that the making of an agreement in this State providing for arbitration to be held within this State is to be deemed a consent of the parties to the jurisdiction of the courts of this State to enforce the agreement by the making of any orders provided for in this title and by entering of judgment on an award under the agreement.
