Employment Agencies and Counseling

Title 2.91 of Part 4 of Division 3 of the Civil Code deals with employment agencies, employment counseling, and job listing services act. Chapter 1 contains general provisions.

Section 1812.500 names the title the Employment Agency, Employment Counseling, and Job Listing Services Act.

Section 1812.501 defines the following terms: “employment agency,” “agency,” “employment counseling service,” “employment counseling service,” “customer,” “job listing service,” “nurses’ registry,” “jobseeker,” “employer,” “job order,” “domestic agency,” “deposit,” “fee,” “registration fee,” and “person.”

Section 1812.502 provides that this title does not apply to any person who provides any of the services described in law and who charges fees exclusively to employers for those services. The exemption from regulation provided by this subdivision does not apply to any person who provides babysitting or domestic employment for others.

This subdivision does not apply to an employment counseling service. This title does not apply to any nonprofit corporation, organized for the purpose of economic adjustment, civic betterment, and the giving of vocational guidance and placement to its members, or others, including employment counseling services, when all of the three specified conditions exist.
