Time Limitations for Arbitration Awards

Deals with limitations of time for the enforcement of arbitration awards in California

Part 3, Title 9, Chapter 4, Article 2 of the Code of Civil Procedure deals with limitations of time for the enforcement of arbitration awards in California.

Section 1288 requires a petition to confirm an award to be served and filed not later than four years after the date of service of a signed copy of the award on the petitioner. A petition to vacate an award or to correct an award must be served and filed not later than 100 days after the date of the service of a signed copy of the award on the petitioner.

Section 1288.2 specifies that a response requesting that an award be vacated or that an award be corrected ist to be served and filed not later than 100 days after the date of service of a signed copy of the award upon the respondent in two specified manners.

Section 1288.4 prohibits any petition from being served and filed under this chapter until at least 10 days after service of the signed copy of the award upon the petitioner.

Section 1288.6 states that, if an application is made to the arbitrators for correction of the award, a petition may not be served and filed under this chapter until the determination of that application.

Section 1288.8 explains that, if an application is made to the arbitrators for correction of the award, the date of the service of the award for the purposes of this article must be deemed to be whichever of the two specified dates is the earlier.
