Judge David Milton is not being shy about his ‘law and order’ stance

Judge David Milton is running for Los Angeles District Attorney and is not being shy about his “law and order” stance.

In the recent debate, he discussed the death penalty, how “smash and grab” robbers can and should be charged with felonies, and how current DA George Gascon has failed to protect the public.

When warranted, the death penalty will be sought if and when he becomes district attorney , Milton said.

“Gascon wished the death penalty off the table in every case,” said Milton.

Milton noted that California voters have approved and supported the death penalty at the polls TWICE in recent years.  As a prosecutor in the DA’s office – where he worked in major crimes before becoming a judge – he got two death penalty convictions, convictions that withstood the standard years of appeals.

“I do not take the death penalty lightly, but it must be an available penalty in the most extreme cases,” Milton said.  Milton even helped write proposed death penalty enhancement laws (one involving drive-by shootings) though they were not adopted by the state legislature.

Milton was born in Pasadena but grew up in Indianapolis.  After leaving the army, he returned to Pasadena, eventually joining the LA DA’s office as a deputy in 1978 and became a judge in 1995.

The now-prevalent “smash and grab” robberies are not petty theft, as Gascon seems to think, but felony burglaries and robberies and should be prosecuted as such.  Specifically, any incident involving force or fear or was pre-planned (pretty much a given if two people are involved) are felonies, Milton said.

“There are plenty of avenues to charge these people with felonies,” said Milton, referring to a variety of charge enhancements – like use of a gun –  that Gascon flatly refuses to add to any charges.

While he believes that use of a gun in a crime deserves enhanced charges, Milton – a gun owner himself –  strongly supports the second amendment and the right of “law abiding people” to have guns.  He added that people with concealed carry permits are not the people with guns society should be worried about.

Gascon’s cognitively dissonant diametrically opposed gun stances – pro gun control, but against charging people for using a gun in a crime – seems to be part of Gascon’s larger ideological predilections.

“There is a movement to disarm the public, there is a movement to open the borders, there is a movement to release criminals, and there is a movement to eliminate the police,” Milton said.

Gascon’s politics are a major part of the current problems Los Angeles is facing.  “What offends me about Gascon is he stubbornly refuses to file enhancements when he does not have that discretion,” Milton said.

And Milton is particularly offended by Gascon’s injection of race into criminal justice.

“I’m mixed race,” Milton said.  “And Gascon throws race into cases to use as a wedge issue with minority communities and it’s not true at all.  It’s just another one of his devious tactics and one of the reasons why I’m running.”
