Disaster Indemnity for State Militia

Money accruing to the Indemnity Fund is appropriated for carrying out the purposes of this article

California’s Military and Veterans Code, in Division 3, Chapter 6, Article 3.8, provides for disaster indemnity among state benefits for veterans.

Section 989.4 requires the department to maintain an Indemnity Fund, which was created in the State Treasury, for the purpose of indemnifying eligible purchasers; for the cost of repairing structural damage in excess of five hundred dollars $500 caused by flood; and, for the cost of repairing structural damage in excess of 5% of the total covered loss or $500. Money accruing to the Indemnity Fund is appropriated for carrying out the purposes of this article.

Section 989.5 requires all purchasers to participate in the Indemnity Fund. Purchasers must pay a reasonable charge, prescribed by the department, in addition to the regular monthly installment. Money collected is deposited in the Indemnity Fund.

Section 989.6 requires the department to prescribe and publish rules and regulations for the administration of the Indemnity Fund.

Section 989.7 authorizes the department to purchase insurance against any risk, or portion of any risk, otherwise payable out of appropriated moneys in the fund. The department must make an annual report on or before September 1st of each year to the Legislature regarding any insurance coverage implemented or required by it. The report must include specified information.

Section 989.8 requires eligible purchasers to be indemnified pursuant to this article solely from moneys in the Indemnity Fund, and the state will not be liable beyond the assets of the Indemnity Fund for any obligation in connection therewith.

Section 989.9 proclaims that nothing in this article imposes any liability upon a purchaser electing to participate in the Indemnity Fund for any obligation imposed under this article, except for participation charges as specified.
