Newsom’s Latest Medical Laws: California Defies Other States and Medical Realities

California has positioned itself as a sanctuary for procedures that remain illegal or restricted elsewhere

Governor Gavin Newsom has signed another round of legislation that treats California medical providers as instruments of state policy rather than participants in a federal system of law. The new measures prohibit or tightly restrict healthcare providers from turning over medical records related to “gender-affirming care” or abortions in response to out-of-state subpoenas, court orders, or investigations. This builds on earlier shield laws that already aimed to protect patients and providers from other states’ laws. Now the state is directing providers to route such demands through the Attorney General and, in practice, to resist compliance.

California has positioned itself as a sanctuary for procedures that remain illegal or restricted elsewhere. Previous shield statutes limited cooperation with other states’ criminal or civil actions involving abortion or gender-related medical interventions, especially for minors. The latest bills, including measures like AB 1930, require entities to notify the Attorney General before responding to inquiries and authorize the AG to intervene to block disclosure. Providers are effectively told that California’s policy preferences take precedence over ordinary legal process.

This is not ordinary privacy protection. Medical records are routinely shared under subpoena, court order, or interstate compact for legitimate purposes—criminal investigations, child welfare cases, insurance disputes, or malpractice claims. Directing providers to withhold records when the subject involves favored procedures creates a two-tier system of law enforcement. It invites a straightforward Supremacy Clause or Full Faith and Credit challenge. Courts have historically been skeptical of states attempting to nullify other states’ laws or obstruct federal investigations through selective non-compliance. Whether the current Supreme Court or lower federal courts will tolerate California’s approach remains to be tested, but the statutes are drafted in a way that almost invites the fight.

Separately, Newsom signed legislation expanding access to pre-exposure prophylaxis (PrEP), including long-acting injectable forms. SB 1023 and related measures aim to reduce administrative barriers so that more clinics and pharmacies can furnish the drugs. PrEP is highly effective at preventing HIV when taken as directed. That is not in dispute. What has received less attention is the behavioral and epidemiological context in which these drugs are used.

Studies and public health data have documented substantial increases in bacterial sexually transmitted infections among men who have sex with men in the years after PrEP became widely available. Some users reduced condom use under the belief that HIV risk was largely eliminated. The resulting rise in syphilis, gonorrhea, and chlamydia prompted widespread adoption of doxycycline post-exposure prophylaxis (DoxyPEP)—taking an antibiotic after sex to prevent bacterial STIs. DoxyPEP was studied and recommended primarily for high-risk populations as an occasional intervention, not as routine daily or near-daily prophylaxis.

Evidence is now accumulating that this expanded antibiotic exposure is contributing to resistance. Surveillance data show sharp increases in tetracycline-resistant Neisseria gonorrhoeae, including high-level resistance, coinciding with DoxyPEP rollout. Some isolates also show reduced susceptibility to other antibiotics still used for treatment. Resistance genes have appeared more frequently in bystander bacteria such as Staphylococcus aureus among DoxyPEP users. Public health agencies continue to recommend the strategy for certain groups while acknowledging the resistance trade-off. The pattern is familiar: a medical intervention intended for a narrow purpose is scaled to a broader population with different risk behaviors, producing secondary consequences that were foreseeable but downplayed.

Reports of unusual gastrointestinal illness clusters and concerns about antibiotic-resistant organisms circulating in certain networks have appeared in outlets covering urban sexual health. Whether every anecdotal outbreak is directly attributable to DoxyPEP is secondary to the broader pattern. Expanding access to PrEP without parallel emphasis on behavioral risk reduction or rigorous stewardship of companion antibiotics simply accelerates the same dynamic. California’s policy preference is to maximize pharmaceutical access while treating downstream STI and resistance trends as problems to be managed with still more interventions. Daily use of both PreP and DoxyPEP are a pharmaceutical company’s wet dream: double customers for life.

These laws reflect a consistent governing approach. Declare certain medical practices politically protected, and then use state power to insulate them from external legal scrutiny and from ordinary epidemiological feedback. Shield statutes that escalate toward non-compliance with court orders test the limits of interstate comity and federal supremacy. Expanded PrEP access, layered on top of already elevated STI rates and emerging resistance, prioritizes volume of prescribing over long-term antimicrobial effectiveness. Both are ripe for scrutiny—legal in one case, scientific and public-health in the other. California’s legislature and governor have chosen to double down. The courts and the resistance data will eventually respond.

  1. After CMA rabidly endorsed “covid” persecution of non-compliant MD’s, who could lose their medical licenses if they did not get in line with the Democrat “covid” party line consensus, anything coming from the CMA should be shunned entirely by all responsible persons in this state.

Shame, CMA, shame. You have not yet healed thyself.
