Offenses Under the State Contract Act

Felonies under this law are punishable by imprisonment

In the California Public Contract Code, Division 2, Part 2, Chapter 1, Article 9, there are specified offenses under the State Contract Act.

Section 10280 provides that any officer or employee of the department who corruptly performs any official act to the injury of the state, is guilty of a felony.

Section 10281 specifies that any contractor or his agent or employee who corruptly permits the violation of any contract awarded under this part to the injury of the state, is guilty of a felony.

Section 10282 states that any subcontractor or agent or employee of any contractor or subcontractor, who has knowledge of any work being done in violation of any contract under this part and does not immediately notify the department or the inspector or resident engineer upon the project of the violation, is guilty of a felony.

Section 10283 specifies that the felonies under this law are punishable by imprisonment under Penal Code Section 1170(h).

Section 10284 provides that persons convicted under this law are also liable to the state for double the amount the state may have lost, or be liable to lose by reason of the acts made crimes by this article.

  1. This reminds me of a certain instance when the state purchased a billion dollars of a certain mask that initially had quality problems from a foreign company as directed by our governor. I also seem to recall that inferior Chinese steel was used to repair the Bay Bridge. I do not know which politicians were involved with this purchase of the steel but I’m sure that Katy Grimes does. The inferior quality was directly tied to the death of several folks.
    Shortly China’s corrupting of American politicians will come front, and center and it will cost the corrupt politicians their jobs and, in some cases, it could lead to being charged with a felony.
