State Agency Buy Recycled Products Campaign

The Legislature declares that the policy and intent is to set an example for the state and nation

Under the California Public Contract Code, Division 2, Part 2, Chapter 4, there is the state agency buy recycled campaign. Article 1 contains general provisions for the campaign.

Section 12153 contains nine legislative findings and declarations, including that it is the policy of the state to conserve and protect resources for future citizens as well as the current population of the state. And that the Legislature declares that the policy and intent of this chapter is to set an example for the state and nation to encourage the purchase of products utilizing recycled resources.

Section 12156 prohibits a state agency from purchasing any printer or duplication cartridge for which the manufacturer, wholesaler, distributor, retailer, or remanufacturer places restrictions on the recycling or remanufacturing of that cartridge by any other person. These restrictions include, but are not limited to, three specified items.

A manufacturer, wholesaler, distributor, retailer, or remanufacturer who establishes a recycling or remanufacturing program that is available to its customers may enter into signed agreements with those customers consenting to the return of the used cartridge to the manufacturer, wholesaler, distributor, retailer, or remanufacturer, only for one of two specified purposes.

Each state agency is required to print a statement on the cover of its printer or duplicator cartridge bid packages, or in some other noticeable place in the bid packet, notifying all bidders that it is unlawful to prohibit a printer or duplication cartridge that is sold to the state from being recycled or remanufactured.

This section defines the terms “printer or duplication cartridge,” “recycled, and “remanufactured.”

  1. Excellent! This will keep the printer repair and printer sales people in business. I have yet to see recycled printer cartridges that didn’t eventually cause printer failures.

    Democrats are post pubescent children. They can never see the long term effects of any decision. They just go by what feels good. Why are children being elected to office?

  2. Do you know anything about the supposed Styrofoam ban in grocery stores in California? In my part of the state, at least 90% of the stores have dropped Styrofoam plates, cups, and bowls because they’ve been warned that the state can fine them $50,000 a day if they get caught with them. I was told by a supervisor for a chain of mini markets that they wouldn’t carry Maruchan cups anymore because they come in Styrofoam cups. It’s been very disruptive to the industry.
