On February 9, Assemblyman Frank Bigelow (R-O’Neals) introduced Assembly Bill 513 related to employment and telecommuting. The bill would add Chapter 5 (commencing with Section 1410) to Part 4 of Division 2 of the Labor Code.
In adding Chapter 5, which would be designated as “Telecommuting Employees,” the bill would add Section 1410 to the Labor Code with three new provisions. First, an employee who works from home and is not at the physical location of the employer may receive all required notices and postings under the Labor Code electronically.
Second, an employee who works from home and is not at the physical location of the employer may utilize an electronic signature for any employment-related documents that require acknowledgment of receipt or attestation. Third, the wages of an employee who works from home that are due at the time of separation of employment must be deemed to have been paid on the date that the wages are mailed to the employee.
The bill is expected to have its first hearing in late March.
