Asm. Levine Motion in Assembly to Compel Lawmakers Report COVID Vaccine Status Voted Down

H.R. 71 Would have compelled Assembly Members to Show Proof of COVID Vaccine or lose salary, benefits

Assemblyman Marc Levine (D-San Rafael), author of HR 71, which would compel  members of the Assembly to provide proof of a COVID vaccine or lose salary and benefits, tried to force a motion and vote on the Assembly Floor Wednesday ahead of even hearing the bill.

As the Globe reported earlier this week, Levine’s HR71 is a resolution that said if an Assembly Member did not provide proof of vaccine status, “the Member shall be suspended from exercising the powers of the office, and shall forfeit all salary and benefits derived from the office, until the Member has presented evidence of having received at least one dose of a COVID-19 vaccination or evidence of a disability or medical condition that prevents the Member from receiving the COVID-19 vaccination.”

Levine made a motion on the Assembly floor Monday during session to compel members by September 1, 2021 (today), report their vaccine status to the Assembly Rules Committee.

Levine apparently wasn’t willing to wait for his House Resolution to pass or fail, and tried to make it happen anyway.

Assemblywoman Eloise Reyes (D-San Bernardino) stood to strike the motion and refer it to the Assembly Rules Committee. Assemblywoman Marie Waldron (R-Escondido) seconded the motion, it was voted on and passed. Levine’s motion was sent to the Rules Committee, essentially killing it.

In our earlier article, the Globe asked: “How does the Assembly demand proof of a vaccine or order that another member’s salary and benefits be forfeited if that member was elected by voters?”

“This seems like it disenfranchises millions of voters who voted for these people,” a Capitol source commented to the Globe. “Is this voter suppression?”

Is this even Constitutional?

For now it’s a moot point.

Here is language of HR 71:

WHEREAS, Members of the Assembly are compelled to work together in close quarters where contraction of the virus is more likely; now, therefore, be it

Resolved by the Assembly of the State of California, That a Member of the Assembly shall present evidence that the Member has received at least one dose of a COVID-19 vaccination, or shall present evidence of a disability or medical condition that prevents the Member from receiving the COVID-19 vaccination, by September 1, 2021, or else the Member shall be suspended from exercising the powers of the office, and shall forfeit all salary and benefits derived from the office, until the Member has presented evidence of having received at least one dose of a COVID-19 vaccination or evidence of a disability or medical condition that prevents the Member from receiving the COVID-19 vaccination; and be it further Resolved, That the Chief Clerk of the Assembly transmit copies of this resolution to the author for appropriate distribution.

      See it everyday, double masked in cars, on bikes, walking by themselves. Families in Whole Foods with scuba gear, gloves and masked, woman in her convertible mind you with the top down aaanndd double masked!
      I wish I was making this stuff up but this is the sad reality.
      But they will keep voting for Levine, Pelosi, Breed , never mind all the human excrement on the streets (the real health crisis).

  1. One more insane bill down. That’s good news.
    Wondering if Asm Marc Levine (et al) hoped that Republican Assembly members (all “anti-vaccine” they think?) would resign over this requirement and then the Dems would have the place entirely to themselves? And yes, how could such a mandate ever apply to someone who was elected by voters?
    Seems like these people are losing their grip more and more each time we tune in to their activities. Maybe the best thing to do in response would be to silently wait and let it happen.

  2. I read the article as the same people who want to pass and enforce mandatory vaccine passports on We, The People are not willing to enforce it upon themselves. Hypocrites much?
