California Governor and Democrats Celebrate Bills Calling ICE Agents ‘Donald Trump’s Secret Police’
Gov. Gavin Newsom is about to learn what the Supremacy Clause of the U.S. Constitution means

“Kristi Noem is going to have a bad day today,” California Governor Gavin Newsom posted to his X page Saturday morning. “You’re welcome, America.”
Gov. Newsom was self-indulgent today having signed five bills that he claims will push back against President Donald Trump’s federal government “secret police” tactics, referring to federal immigration arrests of criminal illegal aliens.
Acting U.S. Attorney Bill Essayli showed “zero tolerance for direct or implicit threats against government officials.”
Newsom, who isn’t an attorney, certainly has attorneys on his staff who could have and should have put this dangerous rhetoric to rest months ago.
“Standing alongside leaders of communities terrorized by Trump’s lawless raids across Southern California, Governor Gavin Newsom today signed a groundbreaking package of bills to respond to federal overreach and push back against Trump and Stephen Miller’s ‘secret police’ tactics in California,” Governor Newsom announced Saturday. “The new laws make California the first state in the nation to prohibit federal law enforcement officers, including ICE, from hiding their identities, and make it less likely that federal immigration enforcement officers target children in classrooms and patients in hospitals.”
Saturday, Governor Gavin Newsom signed:
- Assembly Bill 49 by Al Muratsuchi (D-Torrance) — Schoolsites: immigration enforcement.
- Senate Bill 81 by Jesse Arreguín (D-Berkeley) — Health and care facilities: information sharing.
- Senate Bill 98 by Sasha Renée Pérez (D-Pasadena) — Elementary, secondary, and postsecondary education: immigration enforcement: notification.
- Senate Bill 627 by Scott Wiener (D-San Francisco) — Law enforcement: masks. A signing message can be found here.
- Senate Bill 805 by Sasha Renée Pérez (D-Pasadena) — Crimes.
Senate Bill 627, by Senator Scott Wiener (D-San Francisco) bans federal law enforcement officers from wearing masks while performing their jobs, disregarding security risks and officers’ own safety. Lawmakers even imposed criminal penalties for noncompliance as an added bonus, though it is unclear just how the California Legislature will impose fines on federal immigration officers.
Wiener refers to his bill as “landmark” legislation to ban “extreme masking” by local and federal law enforcement, justified by “rising fascism.”

As the Globe has been reporting, Legally, this is quite dubious, and lawmakers know it. Senator Wiener is an attorney. The “‘No Secret Police Act’ (SB 627) is the first of dozens of proposals at the local, state, and federal level to unmask law enforcement officers acting with impunity,” Wiener says.
Deputy Attorney General Harmeet Dhillon confirmed this today when she responded to Newsom’s X post, “This is silly, and futile. The state has no jurisdiction over the attire of federal law enforcement officials.”

Senate Bill 805 requires ICE, Border Patrol, and Homeland Security agents operating in California to clearly identify themselves while conducting operations.
California Assembly Speaker Robert Rivas chimed in, referring to ICE agents as “Donald Trump’s secret police,” and said they “are terrorizing hardworking Californians — but Democrats are fighting back to keep our communities safe from Trump’s heartless and illegal ICE raids. Secret police are un-American. These new laws make it clear: Show some ID, masks off. We will fight as long as it takes to protect California.”
Rivas makes no distinction between the criminal illegal aliens and “hardworking Californians.” Most people have no issue with actual “hardworking Californians,” regardless of their immigration status.
“As ICE agents risk their lives to secure our borders and protect our communities, they’re facing a 700% surge in assaults — a direct consequence of dangerous, inflammatory rhetoric from Democrat politicians,” the White House reported.
The governor also signed AB 49, which Establishes the “California Safe Haven Schools Act,” a new sanctuary practice in Sanctuary California creating sanctuary schools now.
Democrats claim AB 49 “prevents warrantless immigration enforcement on school campuses and prohibits schools from sharing student or family information with ICE.” However, “ICE does not need judicial warrants to make arrests. Like all other law enforcement officers, ICE officers and agents can initiate consensual encounters and speak with people, briefly detain aliens when they have reasonable suspicion that the aliens are illegally present in the United States, and arrest people they believe are illegal aliens.”
Additionally, ICE law enforcement officers cannot show the warrants they are executing to people who aren’t named or involved.
Democrats know this, yet they passed these unconstitutional and illegal laws, and Governor Newsom signed them.

ICE agents will obviously ignore this state law as they are Federal agents. But how will Newsom and the Democrats try to enforce this law?
