The Center for American Liberty, the Dhillon Law Group, and the American Phoenix Project, filed a lawsuit in federal court Friday morning against California Governor Gavin Newsom and other state officials on behalf of five Californians who had life defining moments #RuinedByNewsom by denying their constitutional rights.

Also named are California Attorney General Xavier Becerra, Director of the Governor’s Office of Emergency Services Mark Ghilarducci, and State Public Health Officer Sonia Angell.

Named in the lawsuit are:

Plaintiff Monica Six of Orange County had her April 21, 2020 wedding #RuinedByNewsom.

Plaintiffs Derek and LaurieSue Medlin have been denied access by Newsom, for all but 30 minutes twice a week to their special needs son who lives in a non-medical residential home that provides 24/7 care.

Plaintiff Bailey Batten of San Diego had her high school graduation #RuinedByNewsom.

Plaintiff Jane Doe is a breast cancer survivor, her surgeon deems it necessary to schedule a reconstruction surgery. However, the surgeon cannot schedule this necessary surgery because Newsom is refusing hospitals to perform “cosmetic” procedures.

The lawsuit states:

“Defendants have used the Coronavirus pandemic to expand their authority by unprecedented lengths, depriving Plaintiffs and all other residents of California of fundamental rights protected by the U.S. and California Constitutions, especially but not limited to, the right to travel, the right to liberty, the right to the equal protection of the law, and the rights protected by the California Emergency Services Act. It is this Court’s duty to defend these constitutional and statutory principles by safeguarding the rights and liberties of Californians that Defendants violate.”

“On April 27, 2020, Attorney General William Barr sent a memorandum to all United States Attorneys regarding civil rights violations occurring in various states during the coronavirus crisis.1 2. Attorney General Barr stated that “the Constitution is not suspended in times of crisis.”

“In his memorandum, Attorney General Barr directs all United States Attorneys to identify state directives that could be violating the Constitutional rights and civil liberties of individual citizens. Attorney General Barr then directs that: If a state or local ordinance crosses the line from an appropriate exercise of authority to stop the spread of COVID-19 into an overbearing infringement of constitutional and statutory protections, the Department of Justice may have an obligation to address that overreach in federal court.”

“This lawsuit is filed to challenge the very type of overbearing infringement of constitutional and statutory protections identified by Attorney General Barr.”

“The State Order and Defendants’ enforcement thereof infringe upon (I) the right to travel under the Fifth Amendment, (II) the right to liberty under the Fifth Amendment, (III) the right to the equal protection of the laws under the Fourteenth Amendment, (IV) the rights protected by the California Emergency Services Act, and (V) the right to liberty under Article 1, Section 1 of the California Constitution.”

This is lawsuit #10 by the Center for American Liberty and the Dhillon Law Group. Each of the cases can be found here.

  1. Unfortunate, but you get what you vote for. The lawsuit has zero chance of success. The Covid -19 pandemic has been a great success for the democrats and their policies.

  2. Instead of a lawsuit, perhaps they should carefully review who they vote for in the next couple of election cycles; we need to end one-party rule here in Calizuela or abuses of power will continue indefintely.

  3. People are shocked, feel helpless, miss their $5.50 fancy latte……

As a child during WW2 my mom and I lived in one room and we had sliced bread soaked in milk for dinner.

She was a payroll clerk in a steel mill, my dad on a battleship at Midway, Leyte Gulf, etc. We were dirt poor, but didn’t know it.
My job was looking for ration coupons on the floor of grocery stores that allowed you to buy some meager amount of sugar, butter, gasoline, meat.

All my relatives were either in military or being worked to a frazzle for the war effort, a generally lost generation…..

  4. Stupid people!!! We are in a pandemic. I really do hope someone close to you gets sick enough to be in the hospital so that you stop being selfish. Be thankful. And vote because of the idiot president we all got screwed. So sue the president. Because that’s probably who you voted for the big ass numnuts that screwed us all.

    1. I suppose if you burn dinner it’s Trumps fault. Can’t you guys at least show a little originality and honestly state any truthful reasons for mishaps instead of knee jerkingly saying “Trump” for everything negative. Stop drinking the CNN kool aid and show some honesty when commenting on any social issue. You must have forgotten when Biden apologized to Trump after his criticism of regulating travel here from China early on. Oops, that doesn’t fit the mandatory liberal herd response of “Trump” whenever something is inconvenient. Hey wait, my car won’t start-“Trump!”

  5. My mother died of cancer because during the pandemic no doctor would see her because of newsomes pathetic rules and it was too late treating her once people were allowed to be seen again .
