SB 428: Harassment Temporary Restraining Orders
Bill would authorize employer to seek a TRO on behalf of the employee and other employees

Senate Bill 428 by Sen. Catherine Blakespear (D-Encinitas) was introduced to authorize any employer whose employee has suffered harassment to seek a temporary restraining order and an injunction on behalf of the employee and other employees. SB 428 would amend Code of Civil Procedure Section 527.8.
In addition, SB 428 would add the following definition of “harassment” to mean “a knowing and willful course of conduct directed at a specific person that seriously alarms, annoys, or harasses the person, and that serves no legitimate purpose. The course of conduct must be that which would cause a reasonable person to suffer substantial emotional distress, and must actually cause substantial emotional distress.”

Why should an employer seek a temporary restraining order and an injunction on behalf of an employee and other employees if that employee has suffered harassment? This is not the responsibility of employers? Democrat Sen. Catherine Blakespear is the former mayor of Encinitas and the Chair of the San Diego Association of Governments (SANDAG). She’s a radical leftist Democrat whose leadership involved controversy and questionable ethics. While Blakespear was the Chair of SANDAG, two audits that found blatant abuse of taxpayer dollars that included unauthorized credit card purchases and the purchase of hundreds meals often at upscale dining spots with bills topping out at more than $100 per visit. Blakespear refused to speak to San Diegans about her failure to lead the agency. As Encinitas’ mayor, she said that she was proud of her record on public safety even though property crime rose by 37% in 2021 according to SANDAG. Blakespear declared that “housing was a right” but she failed to reduce the homeless encampments in the city. She was often photographed with Gov. Newsom and she supported his policies like his gas tax rebate claiming that she didn’t want California’s gas tax reduced because that would have the “undesirable environmental consequences as well by encouraging more vehicle usage.”
She looks like the Cheshire Cat with that toothy grin and up to no good.
