Gov. Newsom Signs AB 1041: Expands Family Leave to Include Non-Family

On September 29, 2022, Governor Gavin Newsom signed into law Assembly Bill 1041, by Assembly Member Buffy Wicks (D-Oakland). AB 1041 amends Government Code Section 12945.2 and Labor Code Section 245.5 relating to expansion of the California Family Rights Act (CFRA).
CFRA makes it an unlawful employment practice for a California public employer or a private sector employer with 5 or more employees to refuse to grant a request from an employee who meets specified requirements to take up to a total of 12 workweeks in any 12-month period for family care and medical leave.
AB 1041 expands the class of people for whom an employee may take leave to care for to include a designated person, who would be identified at the time the employee requests the leave. An employer would be allowed to limit an employee to one designated person per 12-month period.
Existing state law, the Healthy Workplaces, Healthy Families Act of 2014, generally entitles an employee who works in California for the same employer for 30 or more days within a year to paid sick days, including to care for an employee’s family member. AB 1041 expands the definition of the term “family member” to include a designated person.
Section 1 of the bill amends Government Code Section 12945.2 to add a definition of the term “designated person” to mean “any individual related by blood or whose association with the employee is the equivalent of a family relationship. The designated person may be identified by the employee at the time the employee requests the leave. An employer may limit an employee to one designated person per 12-month period for family care and medical leave.” It would also expand the leave to care for a designated person who has a serious health condition.
Section 2 of the bill amends Labor Code Section 245.5 to add a designated person, which means “a person identified by the employee at the time the employee requests paid sick days. An employer may limit an employee to one designated person per 12-month period for paid sick days.”

how soon will it be before the employer will be required to actually pay the employee when they go on these “leaves”?
So Democrat Gov. Newsom signed into law AB 1041 authored by Democrat Assembly Member Buffy Wicks that expands the class of people for whom an employee may take leave to care for to include a designated person, who would be identified at the time the employee requests the leave, and that an employer would be allowed to limit an employee to one designated person per 12-month period? What is the backround of Democrat Assembly Member Buffy Wicks? She graduated from the University of Washington in 1999 with a B.A. degree in political science and history. Wicks’s started her political career in the early 2000s in the San Francisco Bay Area working as a Democrat organizer specializing in “grassroots mobilization and outcome-based organizing.” She worked on the unsuccessful 2004 presidential campaign of Howard Dean and was one of the early hires on the 2008 presidential campaign for Barack Obama. She was tapped by President Obama to serve in the Executive Office of the President as the Deputy Director of the White House Office of Public Engagement. From 2010 to 2011, Wicks “served as Rahm Emanuel’s campaign manager in early months of campaign and developed core strategy and positioning in race as well as early infrastructure.” In 2012, she joined President Obama’s re-election effort and served as the National Director of Operation Vote where was responsible for mobilizing voters in demographic groups including African American, Latino, women, and the youth.
From 2014 to 2015, Wicks transitioned the super PAC Priorities USA Action into a pro-Hillary Clinton vehicle and served as its executive director. In 2016, Wicks was named the California State director by Clinton’s presidential campaign in advance of the June 7 primary. In 2017, Wicks declared herself a candidate for the 2018 California State Assembly election and won the general election with 56% of the vote. Buffy Wicks has never run a business. She is an entrenched career Democrat bureaucrat who lives off of taxpayers? No doubt she never passes up any “payoffs” from special interests?
Buffy “Shark Eyes” WIcks is the PROTOTYPICAL “Community Organizer”/slimewad grifter politician who’s never made a payroll, never managed a company, never had any military service, only grifted off the political “power players” and makes rules and laws that are not founded in any economic reality or sense of benefit to the population at large…
She’s strictly in it for the power, profits and prestige that politics provides in “The Swamp” and her DEAD EYES bely her lack of soul, morals or ethics….
She is DANGEROUS….
Yes, she is especially a danger to the unborn!!
