The ‘right to choose’ does not apply to childhood vaccination schedules in California

Despite threats of arrests by the California Highway Patrol, opponents of SB 276 by Sen. Richard Pan (D-Sacramento) who attended the Assembly Appropriations Committee hearing Friday at the California State Capitol, stood on chairs and voiced their opposition to the bill which will end all medical exemptions to state mandated childhood vaccinations.

Most of the parents protesting already have “vaccine-injured” children, and want the medical exemption for their other children.

Committee Chairwoman Assemblywoman Lorena Gonzalez opened the hearing Friday announcing that she would take SB 276 out of the order of bills scheduled “for the people who traveled.” And then she announced that the bill was passed out of the committee “on a ‘B’ roll call,” meaning all committee Democrats voted “yes” to pass it out, and all Republicans voted “no.”

That’s when the shouting and chanting started.

“You have not represented California for all,” the SB 276 opponents chanted, and chanted and chanted, while Gonzalez carried on with her hearing.

In prior hearings on SB 276, Sen. Pan said, “I want to make sure that every child who needs a medical exemption gets one. That is part of the purpose of this bill.”

But it hasn’t worked out that way.

Parents say because of this bill, they are already running into doctors offices who won’t touch a valid vaccine exemption request. In calling 882 California doctors to ask for a medical exemption for a child who suffered anaphylactic reaction after their 12 month shots, they were told no.

“Unfortunately at our office we wouldn’t do that for you.”

“Our doctors do not write medical exemptions.”

“We have a strict rule here that all children are immunized without exception.”

 

 

A Capitol friend outside the hearing room said, “SB 277 got in between a mama and her cub. SB 276 gets in between the mama, cub and the pediatrician.” He’s referring to all of the mandatory vaccine bills: AB 2109, SB 277, SB 276.

And that is the primary objection by parents to Senate Bill 276 – it disallows medical exemptions, even for families with previously vaccine-injured children.

Senate Bill 276 would eliminate almost all vaccine medical exemptions, allegedly to crack down on fraud, California Globe reported. “Under this bill, State bureaucrats — not physicians –would be in charge of deciding whether children may receive medical exemptions and thus whether they can attend school.”

Sen. Pan claims “According to the author, in the first four months of 2019, 465 measles cases have been reported across 19 states, a number far surpassing last year’s number of cases,” SB 276 bill analysis says. However, these parent-opponents of SB 276 did their homework and found that more than half of the adult measles cases in California were vaccinated.

More than 600 parents opposed to SB 276 peacefully rallied Wednesday at the Capitol, with most carrying signs around the outside of the Capitol, ahead of the Appropriations vote Friday. They reported talking with lawmakers and staffers about their concerns with SB 276.

While proponents of SB 276 call opponents “anti-vaxxers,” at every hearing I’ve attended since Sen. Pan’s first bill mandating vaccinations, AB 109, the majority of parents say they aren’t anti-vaccination, they just want to decide when their infants and toddlers receive the immunizations, rather than the state deciding.

 

Parental choice and decision making over childhood vaccinations was removed in California because of a state law passed in 2012. Assembly Bill 2109 by then-Assemblyman Richard Pan (D-Sacramento), orders that California school-aged children will not be allowed to attend public school without proof that parents have been counseled, and children vaccinated, in accordance with the vaccination schedule of the federal Center for Disease Control.

The only exception to the law was a personal belief or religious exemption – the only way Pan could get the bill passed.

As attorney Mary Holland warned this week at California Globe, “If the government wants to mandate vaccinations, it must ensure that they are safe for all children.” And that is all parents want.

 

Four years later, Sen. Richard Pan came back with another bill, Senate Bill 277, to remove even the personal belief/religious exemption, following the measles outbreak at Disneyland. “We are in a situation where there are not enough people being vaccinated to contain these dangerous diseases,” Pan said at a news conference in February 2015. But he refused to address parents’ concerns about the volume and safety of vaccinations given to children.

But that wasn’t enough.

Sen. Pan came back again in 2019 with SB 276 , to address the medical exemptions parents were receiving from family physicians. SB 276 requires the Department of Public Health to develop a statewide standardized medical exemption request form for immunization requirements; requires the request form to be the only medical exemption documentation that a governing authority may accept; requires a request form to be approved or denied only by the State Public Health Officer.

    1. SB 276 effectively ends medical exemptions because it has disallowed a physician’s medical judgement in determining whether a medical condition could be worsened by a vaccine. The “oversight” (cute term by the way!) in the bill requires that a state employee determines whether the child has suffered a table injury as described in the vaccine compensation program. If the child has not suffered a vaccine table injury they are not allowed to get an exemption. Doctors that were giving legitimate exemptions in order to PREVENT a vaccine injury, were told that they should not write them. This legislation basically wants to codify the bullying that has been going on by legislators towards doctors that dare to stand up against the unreasonable expectation that every child can safely receive a vaccine- until they prove otherwise by becoming seriously injured. The vaccine compensation program was developed in order to compensate someone for a lifelong injury from vaccines. It was not developed to provide a guideline for which medical conditions would necessitate a temporary or permanent medical exemption. Only a physician working with ones patient would be able to do that. We can’t require that every child suffer a lifelong injury before getting a medical exemption. But I’m sure the above poster already understands that, and simply does not CARE. Unfortunately there are too many individuals who believe that media sound bites encompass all the risks of a vaccine, when really all they focus on is anaphylactic shock-leaving out many other medical problems that can impact a child’s health after a vaccine is received.

    3. Essentially ends them all. Your child will have to go into anaphylactic shock or a comma in order to be exempt from just ONE vaccine. They’ll still have to have the rest in order to stay in school.

    1. Brian, this is not anti-vaccine at all This is about parents and doctors being able to make the decisions without the state getting in between them. All of the parents I have talked to aren’t anti-vaccines; but they are questioning why even vaccine-injured children are not given medical considerations regarding future vaccinations, as well as other siblings. That’s all.
      If you read the entire article you will see that.

        Make no mistake, this isn’t about “parental rights” or “health freedom” or anything like that. Those are all excuses for pure anti-vaccine activism. Look at the details-

        The author claims in the first paragraph that the “will end all medical exemptions to state mandated childhood vaccinations”.
        Nope. The bill says the opposite. If you can point out where the bill aims to “end all medical exemptions”, I’ll donate $10,000 to the charity of your choice.

        In the second paragraph, the author says “most of the parents protesting already have “vaccine-injured” children”.
        Nope. The scare quotes are appropriate, because for the vast majority of cases, the children of these parents are not vaccine-injured, but rather have conditions completely unrelated to vaccination (like autism, etc.), but the parents are looking for a scapegoat.

        The anti-sb276 crowd is full of anti-vaccine activists and conspiracy theorists, like RFK Jr. and those you quote in the article. If they really cared about “informed consent”, then why are they fine with promoting such blatant misinformation?
        Contrary to their chants and picket signs-
        Yes, vaccines are extensively tested for safety and efficacy.
        Yes, they are tested against placebos.
        Yes, the unvaccinated are far more likely to become infected compared to the vaccinated.

        So why do the “no on SB276” people allow such dishonesty in their activism?

They only studied it for 5 days before bringing it to the FDA and got it approved. Oh and when it comes to a placebo, the Aluminium adjuvant is what they use to test for safety. *Not an inert substance.

          The saddest part, Brian, is the fact that people like you want to assume that these mandated medical toxic products/procedures are necessary for the sake of human kind.

          We survived with our them before and we had the healthiest nation. Now, along with the rise of autoimmune diseases, ADD, asthma, Gillian Bare Syndrome, Autism, there is the same rise in Vaccines.
          We went from 3 different vaccines ( 16 shots) to 16 vaccines (72 vaccines) and they have never ONCE tested the schedule. If they have please show me I would like to see it, I have been searching for 9 months.

          I thought they were nothing but safe, effective, and save lives… until I looked Deeper into what I was being told.

          Brian, if you want to see it for yourselve go to the CDC website and look at the Pre-licensure studies and see what the Regulatory aggencies think is “safe”.

          If you look at your food labels, why wouldn’t you look at your vaccine label? You would be surprised to know the amount of Aluminium in the Hep B vaccine contains 14.8 x more Aluminium than what is the allowed INGESTED amount…

          Read between the lines, do your own research, and don’t damn people for wanting to choose what medical procedures they want for their child, when those parents have done more research than most nurses and doctors have. Not saying the doctors and nurses are dumb, they just have been going along doing the standard procedures, doing what they are told…

          if Autism comes at the age that we are vaccinating… then shouldn’t we just vaccinate when they are older than 1&2&3 years old.

          Go look at the CDC schedule, tell me if it okay with you. Then, go look at the Adult CDC schedule and get caught up. Chances are you haven’t been vaccinated in 3-5 years and your vaccines have worn off.. So, go get vaccinated you walking “Anti-vaxxer”

            For example, Stephanie said “They only studied [the Hep B vaccine] for 5 days before bringing it to the FDA and got it approved.” This is completely false, and just a few minutes looking up the clinical trials reveals that there were literally thousands of people involved in dozens of studies and they lasted several years. Anti-vaccine fraudsters make up nonsense and know their followers are too gullible to notice.
