Trump’s New Executive Order Targets Mail-In Ballots with Citizenship Verification, Democrats Vow To Sue

The order directs the Department of Homeland Security and Social Security Administration to compile verified lists of voting-age U.S. citizens in each state and share them with election officials

President Donald J. Trump delivered a decisive blow to the unverified expansion of mail-in voting on Tuesday, signing a sweeping Executive Order titled “Ensuring Citizenship Verification and Integrity in Federal Elections.” The order directs the Department of Homeland Security and Social Security Administration to compile verified lists of voting-age U.S. citizens in each state and share them with election officials. 

It further instructs the U.S. Postal Service to transmit mail-in and absentee ballots only to individuals on those approved lists — packaged in secure, trackable “Official Election Mail” envelopes with unique barcodes — while directing the Department of Justice to prioritize prosecutions of non-citizen voting and illegal ballot distribution. 

Trump hailed the move in the Oval Office as essential to “stopping the massive cheating that has gone on” and restoring trust in federal elections ahead of the 2026 midterms. The EO leverages existing federal statutes like the Help America Vote Act and National Voter Registration Act to enforce citizenship requirements without directly rewriting state election laws — though Democrat officials immediately branded it an unconstitutional power grab.

California Governor Gavin Newsom vowed to fight the order “every step of the way,” declaring, “We’re challenging it. See you in court.” Attorney General Rob Bonta called it a “dangerous and unprecedented escalation,” while U.S. Senator Alex Padilla labeled it a “blatant, unconstitutional abuse of power” that weaponizes federal agencies against state sovereignty. California — which pioneered universal mail-in ballots and has repeatedly battled GOP efforts to require voter ID — is expected to join multi-state litigation alongside its deep-blue allies.

Arizona Secretary of State Adrian Fontes slammed the EO as a “disgusting overreach” and an attempt by the president to “pick his own voters,” promising legal action alongside Attorney General Kris Mayes.

In Nevada, Secretary of State Francisco Aguilar called the directive “illegal,” insisting “states run elections” and claiming widespread fraud allegations are “false” and only create “chaos and confusion” for voters. 

This latest executive action fits a long pattern of election-integrity efforts the California Globe has chronicled. In 2025, we reported on California Democrats’ aggressive defense of its no-excuse mail-in system and the defeat of the California Voter ID and Election Integrity Act of 2025 in the Democrat-controlled legislature — despite widespread public support for basic safeguards. We also exposed ongoing issues with inaccurate voter rolls and ballot-harvesting practices that have drawn repeated lawsuits from groups like the Election Integrity Project California.

In Nevada and Arizona, similar election integrity battles between Republican and Democrats are historical and ongoing. In 2023, Nevada Democrats refused to implement any election safeguards Governor Joe Lombardo proposed, denying hearings for multiple pieces of Republican-led legislation. During the pandemic, the Democratic majority led by Governor Steve Sisolak, removed all election safeguards by ushering in mail-in balloting to every registered voter, unlimited ballot harvesting, and extended dates for ballot tabulation. 

Arizona Republicans have accused Fontes of dragging his feet on cleaning inaccurate voter rolls, weakening signature verification on mail ballots, and stonewalling federal efforts to verify citizenship. Just months ago, the Department of Justice sued many blue states, including Arizona, California, and Nevada, for refusing to turn over unredacted voter registration data needed for basic list maintenance and to root out non-citizens on the rolls.

Republicans and election-integrity advocates cheered the EO as long-overdue common sense. With universal mail-in voting now the norm in states like California and Nevada — where ballots are mailed to every registered voter regardless of citizenship verification — the order targets the very vulnerabilities critics say enabled fraud in close races. 

Trump’s latest move comes as a stark reminder of the very vulnerabilities exposed in California just days ago. In Lodi, Shakir Khan — a Pakistani national living in the Golden State — was sentenced to three years in prison after being caught with 41 completed and sealed mail-in ballots at an address where 71 names were registered to vote. The scheme, which surfaced in a local city council race, was exactly the kind of ballot harvesting and fraud Democrats insist “doesn’t happen.” Yet it did — and Khan’s case is now Exhibit A for why lax mail-in rules invite staggering abuse.

Democrats’ hysterical response only confirms what millions of Americans already know: when election integrity is on the line, Democrats would rather sue than secure the vote.

  1. No surprise the Democrats are fighting this. The matching of names on states’ voters rolls with those listed as citizens by federal records would blow to pieces the Democrats’ argument that illegals don’t vote. What are the Democrats so afraid of if they are so convinced in their position that only legal people are voting? What harm would there be in comparing voter roll names against a federal database? Wouldn’t this just demonstrate to the public that only legal people vote, as the Democrats contend?

  2. Hey, it’s Alex Padilla, the father of Dominion in California, and OF COURSE if there’s rampant state-sponsored FRAUD and CHEATING, they’re gonna howl about any Federal policies to confront that cheating that they belive “weaponizes federal agencies against state sovereignty.”
    California’s “state sovereignty” DISENFRANCHISES conservatives and it’s WAAAAY beyond time that Federal/Adult supervision be applied to reign-in the power-mad Democrats and their policies that have brought California to the brink of economic DISASTER….
