Lawmakers Just Passed Two Bills to Punish Physicians and Curtail Free Speech

AB 2098 and SB 1018 are un-American

Did the headline get your attention? It should.

The two bills will punish non-compliant physicians and curtail free speech. The Globe has covered these bills this year, but they demand additional attention.

AB 2098 by Assemblyman Evan Low (D-Campbell), will punish physicians and surgeons for “unprofessional conduct” for advocating for the potential benefits of early treatment with off-label drugs, or those who dare to ask questions about COVID vaccine safety.

SB 1018 by Sen. Richard Pan (D-Sacramento) is just as dangerous. According to Sen. Pan, SB 1018 will “address the amplification of misinformation and disinformation on online platforms by requiring platforms to publicly disclose how their algorithms work and to share data for research purposes.”

This is Stasi-level legislation.

Under AB 2098, doctors would be subject to disciplinary actions by the Medical Board of California and the Osteopathic Medical Board of California if they do not adhere to the approved COVID treatment consensus.

Who approves the “consensus?”

Physicians would be punished simply for doing what they believe is best for their patients, and sharing legitimate information necessary for their patient to make a true risk/benefit analysis but those who want everyone vaccinated no matter what would consider to be “misinformation.”

PERK, Protection of Educational Rights of Kids, explains:

“The Medical Board will base their consideration on “applicable standard of care” and “contemporary scientific consensus” neither of which currently exist for COVID-19. • (b) Prior to bringing a disciplinary action against a licensee under this section, the board shall consider both whether the licensee departed from the applicable standard of care and whether the misinformation or disinformation resulted in harm to patient health. • This will create a witch hunt for doctors and will drive more experienced doctors out of CA. • This bill goes after our trusted doctors and surgeons who understand that the science is never settled and continue to seek and share the best treatment practices for their patients.”

The bill is aimed at physicians who chose to prescribe therapeutics during COVID, rather only offering  vaccines.

This is what Assemblyman Low said about his bill:

“This bill declares that disinformation and promotion of COVID-19 misinformation and disinformation to the public as unprofessional conduct for licensed physicians and surgeons. Under this law, California Medical Boards will be given the tools necessary to bring discipline actions against a licensee. Due to their specialized knowledge and training, licensed physicians possess a high degree of public trust and therefore must be held to account. The spreading of misinformation, of inaccurate COVID-19 information, contradicts that responsibility and threatens to further erode the public trust in the medical profession and puts all patients at risk.”

Assemblyman Low and Sen. Pan say they authored the two bills “to combat the spread of dangerous COVID-19 misinformation and protect public health.”

They say: “Together, both bills effectively work to discourage misinformation, through algorithm transparency for online platforms and requiring platforms share data with researchers, and through accountability for the small number of unethical physicians and surgeons spreading blatant COVID-19 misinformation and disinformation.”

The lawmakers continued to push the two bills even though Covid is endemic now.

Dr. Marty Makary of Johns Hopkins says “throughout the pandemic, all COVID decisions were made by a small group of like-minded government doctors who often replaced the scientific method with medical dogma.”

He reported that a May report reveals that vaccinated immunity as well as natural immunity has reduced the mortality by about 90% and that omicron is now considered less virulent intrinsically than certain flu strains.

“The medical establishment has marched in lockstep on COVID-19, presenting a consensus of expertise as they marginalized physicians who had different opinions,” Makary said. “Ironically, when public health officials insisted that those who had natural immunity be fired for not being vaccinated, they fired those least likely to spread the infection in the workplace.”

Makary added: “Eventually the data came in. Natural immunity was 2.8 times better in preventing hospitalization than vaccinated immunity and having both meant you had the same protection as natural immunity alone.”

So why did Sen. Pan and Assemblyman Evan Low continue to drill down on their un-American bills? They obviously believe they are necessary to chill online speech and cull physicians who veer too far from directives from public health officials.

Both bills are on Gov. Gavin Newsom’s desk, awaiting his signature or veto. Notably, both bills could put a real damper on Newsom’s presidential aspirations should he sign them.

  1. I CANNOT believe these two bills passed. This is really frightening. This is a clear violation of constitutionally-protected free speech as Jimmy referenced. Do you hear that, you idiot Dem legislators? Do you care? Doesn’t look like it, does it. What it looks like is that you are determined to hurt us as much as possible before there is a constitutional challenge. Until that challenge happens and prevails we are left to cross our fingers that good physicians will not be intimidated by spies (or whatever) and will act independently to actually do what is best for their patients and, additionally, will not be temped to leave California for other states. Really, it’s stunning how much scorched-earth damage malevolent control-freak legislators like Sen Richard Pan (a pediatrician!) and Asm Evan Low have done. And will continue to do.

    1. The Republicans didn’t help in this either or severel other bills that Newsom probably will sign in. Randy Thomasson that is very involved send an email showing how they could have done so much more. We need to know names of everyone that didn’t vote against many of these bills.

  2. When the “consensus” is proven wrong, what is the legal recourse?
    Is this why Newsom himself might have gone to Mexico for his *suspected* clot shot Bell’s Palsy treatment?

    1. When you silence doctors and scientists the “consensus” remains. This is goal, stop any actual knowledge and learning and replace it with state mandated consensus.

  3. I’m pretty sure most Californians want their healthcare provider to tell them their professional medical opinion and not want the government wants them too. Healthcare providers will have to choose. I would like to think most providers will not be willing to put their licenses on the line for sharing false government mandated information, most will continue to give their honest opinion or move out of state to continue practicing medicine.

  4. So – does this mean that patients who are INJURED by taking the “approved COVID treatment consensus” can now SUE Sen. Pan and Assy. Low for their damages incurred from the Experimental Use Authorization products that meet such criteria???

Will be calling the Governor’s office today (see above, end of article) to leave a message urging Newsom to NOT sign these bills, which are a scary and unnecessary intrusion into the private, confidential relationship between ourselves and our doctors who must be free to treat patients as they see fit without interference of any kind from the state.
    Trust in the medical establishment has already been SEVERELY damaged (Covid and its ramifications and ‘misinformation’ from government). We certainly don’t need further shutdown of free thought and medical advice at this point as we slowly recover from the harm govt entities have done to us and to medical institutions.

  8. National Institute of Health now lists Ivermectin (horsewormer-lol) as treatment for Covid-19. Fauci is on record from years ago, claiming HCQ as treatment for coronavirus. Treatments were effective, without the adverse side affects of the vaccines. We know the hospital protocol of remdesivir and ventilators were killing people, and hospitals were given incentives to diagnose for covid and institute these same protocols. God bless and protect the doctors and medical staff that honored their oath.

  9. Regardless of the circumstances of how a women gets pregnant, California believes its your body your body your choice and will give you the option and means of ending it with a abortion. What this bill that comes directly from the greedy profit driven pharmaceutical industry through the curropt piece of garbage of a human politician Richard Pan does is give me and my family no choice but to never get another vaccine or flu shot again. Who in there right mind would knowing the details of this bill that passed? Is this the type of medical treatment we want California. How can you help people and practice medicine under these rules. I’m losing hope for California. In the United States there is nothing that compares to California, its the best. They are making it unliveable. Please someone tell me how to change things and I will do everything I can to help. Voting does not seem to be enough.

    They didn’t take a stand against tbis and many other bills. Randy Thomasson reported about it. We need to know names and they need to know we are not ok with their pathetic stand on critical issues.

  14. The CDC has been politicized and has no credibility. I’ll take the advice of Johns Hopkins or Stanford doctors over anything that CDC mandates. Some of my family lives in Alabama where the schools never closed. None of them are vaccinated and all of the kids and parents got COVID. The kids had to stay home one week with cold like symptoms and then back to school. Did a lot of teachers die of COVID or any of the kids? NO. Newsom and the California teachers union made all the wrong decisions.
