Purpose or Objective of Statute Trumps Literal Meaning
California’s Code of Civil Procedure mandates that courts pursue the intention of the Legislature, or voters’ ballot initiatives, whenever possible

In California courts, the core objective of statutory interpretation is to ascertain and effectuate legislative intent, and the statutory purpose or context can override a strictly literal reading if the literal meaning would lead to absurd results or contradict the manifest purpose of the law.
This leads to the legal and academic discussions about whether California courts prioritize statutory purpose over literal text? Or, should California courts prioritize statutory purpose over literal text?
California’s Code of Civil Procedure mandates that courts pursue the intention of the Legislature (or the voters via ballot initiatives) whenever possible. Courts start by giving the statutory words their usual, ordinary, and common-sense meaning. If the language is clear and unambiguous, the plain text controls without further construction.
When does purpose trump the literal meaning of a statute? If the plain text is ambiguous, or if a strict literal interpretation would yield absurd results that the Legislature could not have intended, California courts look beyond the literal words. They examine the statutory scheme as a whole, public policy, and legislative history (such as committee analyses and declarations of purpose) to align the outcome with the law’s true objective.
And, of course, courts try to harmonize statutes. In other words, related statutes and the broader context of the enactment are harmonized so that specific provisions fit the overarching purpose of the legislation rather than operating in isolation. As a result, there are instances when the judiciary determines that the purpose or objective of a statute must trump the literal meaning of the statutory language.
