California’s Ministry of Truth: SB 771 is Gov. Newsom’s and Democrat’s Plan to Ban Speech They Hate
This isn’t California Democrats’ first rodeo – remember their 2018 attempt to create a ‘Fake News Advisory Council’

California Governor Gavin Newsom and Democrats in the Legislature claim they want to regulate social media over hate speech. Senate Bill 771 by Sen. Henry Stern (D-Los Angeles) claims this is about “Personal rights: liability: social media platforms.”
SB 771 is an “anti free speech” bill, comes entirely from California Democrats, and is designed to silence opposing opinions. The bill is not about moderating hate speech; it’s about banning speech Democrats hate.
This isn’t California Democrats’ first rodeo. In 2018, Democrat California lawmakers pushed legislation to create jack-boot agents of government through a “Fake News Advisory Council” – an Orwellian “Ministry of Truth” for the news they don’t like, I reported. “After having my Capitol Press Credential revoked in 2015 and only reissued after an Open Records Act request of 10-years of press credential applications, and viable threats of a First Amendment lawsuit, it appears Democrats in the California Legislature still don’t believe in making no law abridging the freedom of speech, or of the press.”
That obviously stands today, 10 years later.
BUT WAIT! THERE’S MORE!
In April 2022, the Biden administration announced it had created the Disinformation Governance Board – its own Ministry of Truth – a part of the Department of Homeland Security.
Americans from all walks of life were horrified. Fortunately for the potential enemies of the state, the board’s executive director and disinformation czar Nina Jankowicz had already beclowned herself in videos that went viral, demonstrating her stunning bias and partisanship. Within three weeks the Biden Disinformation Governance Board was shut down, and many Americans heaved a sigh of relief.
But not California Democrats.
The Assembly Floor Analysis lays open the crux of Democrat’s SB 771:
“In 2022, after Elon Musk took over X, the platform formerly known as Twitter, he rolled back its content moderation policies (that means they stopped shadow banning Conservatives). Rates of hate speech on the platform – including posts containing homophobic, transphobic, and racist slurs – spiked by about 50% shortly thereafter.1 In 2025, Meta CEO Mark Zuckerberg followed suit. Citing the reelection of Donald J. Trump, he announced Facebook, Instagram, and Threads would ″remove restrictions on topics like immigration and gender that are out of touch with mainstream discourse.″ 2Meta platform users soon thereafter reported a similar spike in harmful content.”

Under SB 771, people will be fined if the State Censors determine that their social media posts constitute “Violence, intimidation, or coercion… based on race, religion, gender, sexual orientation, immigration status, or other protected characteristics.”
This feels suspiciously like what is taking place in the United Kingdom right now – people getting arrested and jailed for social media posts deemed by some government flak “intimidating,” “offensive” or “racially inappropriate.”
Is the state of California attempting to censor the opinions of Americans on social media? Did Nina Jankowicz move to California?
According to the California Chamber of Commerce, the Computer and Communications Industry Association, and TechNet, which oppose SB 771:
“It is well established that the companies covered by this legislation have constitutional rights related to content moderation, including the right to curate, prioritize, and remove content in accordance with their terms of service. By exposing these companies to civil liability for content they do not remove, SB 771 creates a chilling effect on their editorial discretion. The significant, prescribed civil penalties – potentially amounting into the billions for each violation – would lead platforms to over-remove lawful content to mitigate legal exposure. Therefore, if this law passes, it will almost certainly be struck down in court (see NetChoice v Paxton) because it imposes liability on social media platforms for whether certain types of third-party content are shown to users, as well as the expressive choices social media platforms make in designing the user experience. This violates the First Amendment rights of users and social media platforms.
Moreover, the proposed liability framework likely conflicts with Section 230 of the Communications Decency Act, which provides strong federal protections for platforms against civil liability for third-party content and for good-faith content moderation. Courts (see Twitter,inc v. Taamneh, 598 U.S.__ (2023)) have consistently upheld Section 230 as preempting state-level attempts to impose liability for content hosting or moderation decisions.”
Here is what SB 771 actually says:
SB 771, Stern. Personal rights: liability: social media platforms.
This bill would make a social media platform, as defined, that violates the above-referenced provisions of law relating to personal rights through its algorithms that relay content to users or aids, abets, acts in concert, or conspires in violation of those laws, or is a joint tortfeasor in an action alleging a violation of those laws, liable for specified civil penalties. The bill would declare its provisions to be severable and would declare attempted waiver of its provisions to be void and unenforceable.
Back in 2018, Democrats said the quiet part aloud, revealing their actual intentions:
Democrats are so unhappy with the outcome of the 2016 Presidential election, the only answer they can deal with over the election of outsider Donald Trump is that most of America was too stupid to understand that fake news was being pushed at them by Conservative news outlets. According to Sen. Bill Dodd, the author of SB 830 in 2018: “The prevalence of fake news garnered national attention in the recent Presidential election, where false and misleading stories from hoax websites outperformed actual news stories in terms of social media engagement. This flood of content can make it difficult for the public to differentiate between reputable news sources and false or misleading claims. The practice of advertisements masquerading as news has also seen an increase in recent years.”
Democrats still can’t believe that Americans actually willingly voted for Donald Trump in 2016, or in 2020, or again in 2024.

The term “hate speech” is code for expressing any opinion in opposition of the Democratic Party.
Political censorship involves the suppression of political opinions that oppose the government in power, often violating freedoms of speech, press, or assembly. Governments may conceal, distort, or falsify information to prevent dissent and maintain control, sometimes using tactics such as media bias, imprisonment, or internet shutdowns.
The concept of hate speech is often used as a justification for censorship, particularly when governments or institutions seek to suppress speech they find objectionable. Critics argue that the term “hate speech” is so vague and subjective that it can be weaponized to silence dissenting or unpopular opinions, effectively becoming a tool for censorship rather than a clear legal standard. In the United States, the First Amendment does not recognize hate speech as a distinct legal category, and most expression labeled as such remains protected unless it falls into narrowly defined exceptions like incitement to imminent violence, true threats, or harassment.
Censorship is a fundamental tool for authoritarian governments, used to maintain political control by restricting access to information that could threaten regime stability, challenge official narratives, or incite dissent.
These regimes often justify censorship on grounds of national security, social harmony, or moral protection, while primarily targeting political opposition and independent media. By controlling the flow of information, authoritarian states shape public discourse, suppress press freedom, and monitor or punish critical voices.
This bill even if signed into law, would be quickly overturned by courts. It’s a flagrant violation of the 1st Amendment. Once again Democrats demonstrate that they are literally insane as they keep trying to push the same failed polices over and over again which is the literal definition of insanity. Just consider that according to the Democrats, merely asserting that there are only two sexes is deemed “violent hate speech”. Any judge with a modicum of common sense will look at this law and slap it down immediately. That being said, there are a lot of judges out there who have zero common sense as we have repeatedly been shown these last few months, so if it does become law, expect it to take a while for it to reach a court that is comprised of common-sense judges.
It’s really remarkable how these panicky California Dem-Marxist politicians NEVER stop trying to suffocate us. They should have their OWN hats made up to express this. You know, something like “Shut America Down Again” (SADA).
Toxic SB 771 —- a shut-down-free-speech “nostalgia item” apparently meant to feed those longing for the repellent puppetry of the Biden Admin era —- is something we don’t want on the books for ONE SECOND.
Who knows, maybe when the Gov finally returns from his Prez ’28 World Tour he will have to pay attention to the negative public response of Californians to SB 771 and actually VETO this turkey? After all, why cause himself even MORE problems than he has already?

Well, that didn’t take long. The leftist were all up in arms about free speech with Jimmy Kimmel, and within days, the Marxist California Democrats have a new bill to ban free speech.
YouTube, owned by Google’s parent company Alphabet, had announced plans to reinstate creators whose accounts were terminated for violating its now-defunct COVID-19 and election integrity policies.
In a letter to House Judiciary Committee Chairman Jim Jordan, Alphabet lawyer Daniel Donovan stated the company intends to “provide an opportunity for all creators to rejoin the platform” if their channels were banned under these deprecated policies.
