Senator Sabrina Cervantes Cited for DUI Following Crash in Sacramento
Cervates remains adamant that she was not under the influence at the time

A car crash involving Senator Sabrina Cervantes (D-Corona) led to a DUI citation being held against her in Sacramento on Monday, with the Senator remaining adamant that she was not under the influence at the time of the crash.
According to authorities, Senator Cervantes was driving a sedan on Monday in Sacramento when it collided with an SUV at about 1:30 p.m. Police and EMS arrived to the crash site near 14th Street and S Street. Suffering from minor injuries, Cervantes was then taken to the hospital for treatment. While there, the Sacramento Police continued to conduct their investigation, where they saw that Cervantes was displaying several objective signs of intoxication.
As a result, a DUI investigation was launched. Ultimately, the police cited her with a misdemeanor for driving under the influence of drugs and released her that afternoon. Currently, the type of drug is under question, with test results likely to come back and be released soon. The toxicology will tell what drug, if any, she was under the influence at the time of the crash.
However, Cervantes has adamantly denied being under the influence. In a statement released on Tuesday, Cervantes said that a large SUV struck her car. And, once in the ER, she was then questioned by police for several hours. According to her, she was “involuntarily detained.”
“On Monday afternoon, while seeking care in the emergency room after my sedan was T-boned by a large SUV, I was accosted by Sacramento Police Department officers, falsely accused of driving under the influence, and involuntarily detained for several hours at the hospital,” said Cervantes on Tuesday.
“This ordeal was deeply distressing and left me even more shaken. As a Senator, wife, and mother, I hold myself to the highest standard and expect others that serve our communities to do the same. I want to be clear: I did nothing wrong. The lab results I sought in the hospital show conclusively I had no alcohol in my system. I expect this to be quickly and justly resolved.”
Cervantes’ DUI
While the Sacramento PD could not expand more on the DUI because of the toxicology report still being out, they did look into the accusations that she was “accosted” through body camera footage and talking with hospital staff. They found her accusations to be false, stating on Wednesday that they remained professional and respectful while questioning her.
“Officers conducted a thorough investigation and remained professional and respectful throughout it,” noted the Sacramento PD.
The Sacramento County District Attorney’s Office is also currently limited as to what they can say at this time because of the toxicology report not being released.
“Our office is waiting on toxicology results to be completed. Once we have received those reports, all of the facts in the case will be reviewed for a filing decision. Until then, we will reserve any further comments,” explained the DA’s office.
Cervantes, who was elected to the Senate last year following a stint as a Assemblywoman from 2016-2024, is now the third state lawmaker to get a DUI citation since 2023. She follows Congressman Dave Min (D-CA), who was caught drunk driving in Sacramento in May 2023 while still a state Senator, and former Assembly woman Wendy Carrillo (D), who crashed into two parked cars in Los Angeles in November 2023 while driving double over California’s legal BAC limit.
It should also be noted that Cervantes’ sister, Riverside City Councilwoman Clarissa Cervantes (D), received 2 recent DUIs as well. The two incidents turned out to be a major factor in her Assembly loss last year, failing to succeed her sister in the district and allowing now-Assemblywoman Leticia Castillo (R-Riverside) to win and flip the seat for the GOP.
The toxicology report is to be released soon, which could bring consequences for Senator Cervantes.
Oh great, another drunk in the legislature (Sen Sabrina Cervantes) popped for a DUI. At 1:30 in the afternoon, no less! And an abusive one on top of everything else! In addition to her abuse of law enforcement, once we get the blood alcohol count (assuming she consents to a test, which if she has been around this block before, she won’t) can this please be grounds for immediate expulsion from the state senate? It should be. It’s a conflict of interest, for one, in that these drunk drivers who make laws tend to want soft laws or NO laws for scofflaws. And if she is drunk at 1:30 p.m. is it too much of a stretch to believe she is drunk on the senate floor? Also, DUIs tend to be alcoholics, alcoholics have very poor judgment. Should someone who is probably alcoholic and has very poor judgment be making laws that affect the entire population of the state? I don’t think so.

Get this, CW: When Sabrina Cervantes was a candidate for assembly in 2018, she ended up “winning” the seat, even though her opponent, one Bill Essayli, of all people, was way ahead the night before (by 10K votes, as I recall). That big lead soon went away in the month-long vote-counting aftermath, ballot harvesting and other shenanigans were suspected, and Cervantes, who was the much less qualified and much less impressive candidate when compared to Essayli, “won.”
Count them till the Democrat wins!
I don’t know who the politician is, but my thought is to wait until the toxicology result comes back before throwing a lot of vitriol in this case. I was subjected to a falsified charge of dui, the case was so contrived a blind man in a dark room could have seen it. It is also why if I’m ever stopped again I’ll take the blood draw because it takes the breath test and any subsequent tampering out of the officers’ hands. She might be a political ahole and needs to be called out, so trash her for what she may have done to harm the state and its citizens instead of a yet to be proven offense.
The following is not a defense of either the character or political failings of the subject. One thing I find disturbing is that the police interviewed her for hours, anything they needed to know could have been established within 15 minutes. So, they were harassing, harrying and preasuring someone who could have been subject to a concussion or shock after a car accident in order to advance a case against the woman. I believe in law enforcement, but not all leos are saints and the system is subject to corruption. I once had a concussion and was goofy for a couple weeks, I could have said anything in that condition. I have also been in shock due to injuries. While I support police, I would invoke my 5th amendment rights with “I don’t have to answer your questions.” It is a mistaken notion that your miranda rights have to be recited, you have to claim your miranda rights. Anything you say can be twisted to be used against you, and police officers are trained to use your mouth against you. A plea bargain is essentially an admission of guilt (which is never explained in the deal), the defendent may see it as a way out of a giant hassle. A prosecuter may well overcharge and present the defendent with a choice of three years of probation and a minor conviction or three years in prison on a felony conviction, secure with the knowlege that juries convict something like 98% of cases. The defendent may be guilty of nothing, but was forced into a plea bargain. Everyone who goes to jail will declare innocence, but there are people who do get framed and railroaded. Former Riverside County DA Rod Pacheco was the direct extreme opposite of LA County DA George Gascon as was the San Bernardino County DA in the early 80s. The thought was like “anyone can convict the guilty, but it takes a great prosecutor to convict the innocent.” Those two influenced me to mistakenly vote for proposition 47.
Her case will heard in front of a Sacramento judge. What more could a state senator in the Sanctuary ask for?

Who is Democrat Senator Sabrina Cervantes? She was born and raised in Riverside County, California and her father, Greg, had previously served as mayor of Coachella while her sister, Clarissa, serves on the Riverside city council. She earned a Bachelor of Arts in political science with a minor in public policy from the University of California, Riverside. Since been a Democrat political hack her entire working career. Before being elected, Cervantes served as a District Director for a member of the California State Assembly, and the Director of the California Voter Project.
She’s a member of the California Legislative LGBTQ Caucus and lives in Corona, California, with her wife who works as a hospital technician. She and her wife gave birth to triplets in 2019.

She knew they were not looking for ALCOHOL, they were looking for DRUGS!!!
