Big SCOTUS Win for Trump Admin on Illegal Immigration Deportations
It is absurd to think a District Judge in one district can dictate federal immigration policy impacting national security

The Trump Administration won another decisive decision from the United States Supreme Court Monday after it halted a ruling by a federal District judge in Massachusetts which prohibited the government from deporting immigrants to countries other than their home countries. Boston-based Judge Brian Murphy issued the order and the First Circuit refused to block it, George Washington Law Professor Jonathan Turley said on X.
The case, D.V.D. v. U.S. Department of Homeland Security: it is absurd to think a District Judge in one district can dictate federal immigration policy impacting national security.
“This is a major win that gives the Trump Administration greater options on deportations. Judge Murphy held his order was supported by not just the Supreme Court and Congress, but ‘common sense and ‘basic decency. At a minimum, he was clearly wrong on the first claim by 6-3,” Turley added.
Politico reported:
The justices lifted an order from a federal judge in Boston who had placed restrictions on the deportations to those countries. U.S. District Judge Brian Murphy had issued a nationwide injunction that required the administration to give immigrants “meaningful” advance notice and a chance to raise objections before they are sent to so-called third countries — nations not specified in their original deportation orders. But the Supreme Court granted the Trump administration’s emergency request to put Murphy’s injunction on hold.
Notably, the Associated Press headline today shows their opinion: “Supreme Court allows Trump to restart swift deportation of migrants away from their home countries.”
Even more telling was their lede sentence:
A divided Supreme Court on Monday allowed the Trump administration to restart swift removals of migrants to countries other than their homelands, lifting for now a court order requiring they get a chance to challenge the deportations.”
The court was not “divided” as much as the AP would have you believe – the vote was 6-3, with the usual dissenters Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson. Justice Sonia Sotomayor wrote the dissent stating, that “in matters of life and death, it is best to proceed with caution. In this case, the Government took the opposite approach.”
However, late in the day, Senior Legal Correspondent for the Federalist Margot Cleveland posted to X that “Counsel for illegal aliens try to sidestep SCOTUS stay. Just hours ago SCOTUS stayed injunction entered by lower court regarding removal to third countries. Now attorneys argue court can still bar that removal as a remedy for violations of the PI. Plaintiffs attorneys also argue that Court should enter another identical injunction but solely for the individuals (and not a class action). SCOTUS did not explain why it entered stay, but no reason to belief it was merely because it was a class action injunction.”
A follower said “Lower courts overrule @USSupremeCourt!!”
By evening, she said District Court Judge Murphy sidestepped the Supreme Court order:

This won’t end well for District Judge Murphy or the plaintiff’s attorneys. Trump Derangement Syndrome is in season for far too many judges.
