CA Senate Democrats Pass ‘No Kings Act’ to hold ICE, Border Patrol, Legally Accountable for ‘Lawless Behavior’

The bill is very likely to be challenged by the federal government if signed into law

The California Senate passed Senator Scott Wiener’s (D-San Francisco) bill Senate Bill 747, the No Kings Act.

According to bill analysis:

SB 747 would establish a civil cause of action (lawsuit) for violations of one’s constitutional rights by government officials, and plaintiff’s fees and costs, to be applied retroactively.

Sen. Wiener says the No Kings Act is “first-in-the-nation legislation to hold ICE, Border Patrol, and other federal officers accountable for lawless behavior, closing a legal loophole that holds federal officers to a different standard than state and local law enforcement for constitutional violations.

Oh Boy! Another California first.

Except ICE, Border Patrol and other federal officers are federal officers. And California’s “No Kings Act” isn’t worth the paper the bill is printed on.

Wiener says ICE is “rampaging lawlessly through cities across the nation.”

Actually, created in 2003 as part of the new Department of Homeland Security, ICE has a legal requirement to enforce civil immigration and customs laws and to investigate transnational crime. Legally.

“ICE, Customs and Border Patrol, and other federal agents are displaying a reckless disregard for longstanding constitutional protections as they rampage wildly through American cities,” according to Sen. Wiener.

“Other states have begun to emulate the No Kings Act, but the vote makes the California Senate the first legislative body in the country to pass this groundbreaking ICE accountability legislation,” Sen. Wiener says. “The bill heads next to the Assembly” where it is sure to be passed along party lines.

Sen. Wiener’s press announcement links to an opinion article at the Los Angeles Times by Anita Chabria titled “ICE can’t be trusted. Can California force accountability?” Chabria probably still believes “Hands Up, Don’t Shoot” was real.

Here is her take:

“Before Minneapolis was left to mourn the death of Renee Nicole Good, there was George Floyd.

Same town, same sorrow, same questions — what becomes of society when you can’t trust the authorities? What do you do when the people tasked with upholding the law break the rules, lie and even kill?”

Isn’t it interesting that she notes “same town” but doesn’t delve into why – why is this happening again, in Minneapolis, and not in other cities around the country in which ICE agents are peacefully and successfully rounding up far more criminal illegal aliens.

According to Sen. Wiener:

Senate Bill 747 provides a clear statutory pathway to sue any official — federal, state, or local — who violates a Californian’s federal rights under the United States Constitution. This bill affirms that the United States Constitution is the supreme law of the United States.”

Making it clear that his real complaint is TRUMP, Sen. Wiener says:

“Californians need a way to stand up to this Administration’s unprecedented disregard for their Constitutional rights. Our rights mean little if government agents can violate Constitutional rights of Californians without consequences.”

Anything Democrats don’t like from Republicans becomes unprecedented disregard for Constitutional rights.

There was legal pushback to Wiener’s bill, according to 01/10/26- Senate Judiciary bill analysis:

“Some stakeholders have raised concerns regarding the legal viability of creating such a cause of action at the state level despite its scope being limited to violations of rights afforded by existing constitutional law.”

They note that the bill is very likely to be challenged by the federal government if signed into law.

A number of California law enforcement groups expressed opposition to the bill and argued that the bill represents an expansion of potential liability for them.

The Peace Officers’ Research Association of California argues:

“By creating a parallel and independent pathway for claims, lowering the threshold to mere constitutional deprivations under an objective reasonableness standard, SB 747 dramatically increases litigation risks for peace officers. Officers making good-faith decisions in rapidly evolving situations could face lawsuits in state court without the heightened intent standard that has served as a functional safeguard under existing law.”

  2. Isn’t this just the usual symbolic nonsense from the legislative play-baby Dems, with Scott Wiener pretending to lead the make-believe troops, often as Newsom’s cooperative little hall monitor? More endless attempts to get attention with their limp, concocted grievances that contain nothing solid or real to hang on to? I’m no lawyer, but I know gravitas when I see it, and these people never appear to know the law at all. (Some are saying “Duh!” to that, I think.) This bill seems to reveal, more than anything else, the Dems absolute desperation to be taken seriously. It’s irritating as can be, and if being annoying is the goal, I guess they win! (*eye roll*)

  7. Call your assemblyman and Senator and tell them no. It will be stopped in the courts. This is despicable, clearly punitive and persecution for federal law enforcement officers enforcing federal law democrats don’t like. Wiener is a dangerous tyrant. We need to be able to sue our legislators for what they do to us. Not sue the state, sue them individually.
